Notice of Application for Approval to Expropriate Land

IN THE MATTER OF AN APPLICATION BY The Corporation of the City of Oshawa for approval to expropriate land being Part 3, 40R-33124, PT Lot 9 PL 611, City of Oshawa, Regional Municipality of Durham known municipally as a portion of 490 Conlin Road East, for the municipal purpose of facilitating the reconstruction and widening of Conlin Road East between Simcoe Street North and Townline Road North in the City of Oshawa together with utility and ancillary works associated thereto.

NOTICE IS HEREBY GIVEN that application has been made for approval to expropriate the interests herein described in the land described as Part 3, 40R-33124, PT Lot 9 PL 611, City of Oshawa, Regional Municipality of Durham known municipally as a portion of 490 Conlin Road East.

Any owner of land in respect of which notice is given who desires a hearing into whether the taking of such land is fair, sound and reasonably necessary in the achievement of the objectives of the expropriating authority shall so notify the approving authority in writing,

(a)          in the case of a registered owner, served personally or by registered mail within thirty days after the registered owner is served with the notice, or, when the registered owner is served by publication, within thirty (30) days after the first publication of the notice;

(b)       in the case of an owner who is not a registered owner, within thirty (30) days after the first publication of the notice.
