Notice of Public Meeting May 6, 2024 - City-initiated Amendments
What:
A Planning Act public meeting will be held to consider City-Initiated Amendments to the Oshawa Official Plan and Zoning By-law 60-94 (File: 12-12-4539)
When: May 6, 2024 – 6:30 p.m.
Where:
This public meeting will take place in the Council Chamber, Oshawa City Hall, 50 Centre Street South.
Members of the public wishing to address the Committee through electronic means rather than appear in-person to make a delegation are required to submit their request to speak to this matter no later than 12:00 p.m. on May 3, 2024 by contacting Legislative Services in writing at [email protected].
Members of the public are also invited to submit correspondence concerning this matter. Please address your comments to the City Contact shown below by 4:30 p.m. on April 30, 2024 in order for your correspondence to be provided on the Agenda. Comments received after 4:30 p.m. on April 30, 2024 and up to May 3, 2024 at 4:00 p.m. will be provided to Committee members at the May 6, 2024 Public Meeting.

Why:
- The proposed amendments to the Oshawa Official Plan and Zoning By-law 60-94 include such matters as:
- Amending Section 2 of the Zoning By-law to include an ophthalmologist and a drugless practitioner within the definitions of “Clinic” and “Medical Office”, as well as add a new definition for “Drugless Practitioner”;
- Amending Sections 2 and 26 of the Zoning By-law to add a definition for “Recreational Use” and to permit this use in certain OS (Open Space) Zones;
- Amending Sections 2 and 32 of the Zoning By-law to add a definition for “Seasonal Worker Housing Unit”, amend the definition of “Farm Dwelling”, and add “Seasonal Worker Housing Unit” as a permitted use in the AG (Agricultural) Zones;
- Amending Subsection 3.5 of the Zoning By-law to replace the condition requiring an executed site plan agreement with a condition requiring site plan approval;
- Amending Subsection 3.12 of the Zoning By-law to extend the temporary use permissions for 1399 Simcoe Street North and 382 Simcoe Street North to the year 2027;
- Amending Subsection 4.8 of the Zoning By-law to permit shared driveway access for abutting lots with residential zoning provided a mutual right-of-way access is registered on the title of each property;
- Amending Subsection 4.19 of the Zoning By-law to add a minimum driveway length of 5.75m for an individual driveway leading from a private road or aisle to a private garage of a dwelling unit;
- Amending Subsection 5.12 of the Zoning By-law to update regulations pertaining to accessory apartments (also known as additional dwelling units – A.D.U.s) including regulations related to parking for certain accessory apartments and also the location of the unit in a main building;
- Amending Subsection 5.13 of the Zoning By-law to clarify which provisions in Sections 4, 5, and 39 of the Zoning By-law are to be applied to Parcels of Tied Land (P.O.T.L.s);
- Amending Subsection 2.3.6 of the Oshawa Official Plan and Subsection 11.3 of the Zoning By-law to add site specific conditions to City-owned land at 0 Harbour Road and 20 Harbour Road that are complementary to the land use designation and zoning found on the adjacent property at 80 Harbour Road;
- Amend Article 11.3.3 of the Zoning By-law to modify the site specific conditions of the R6-B(1) Zone applicable to 505 Simcoe Street South resulting from the City’s acquisition of the east portion of these lands, which are to be added to Elena Park; and,

Amend Section 38(B) of the Zoning By-law to delete the reference in Sentence 38(B).2.2(a) to “Simcoe Street North or Conlin Road East” and replace with a general reference to “an arterial road”, to reflect that the MU (Mixed Use) Zone is now more widely applied across the City.
- Amending Section 2 of the Zoning By-law to include an ophthalmologist and a drugless practitioner within the definitions of “Clinic” and “Medical Office”, as well as add a new definition for “Drugless Practitioner”;
- In addition, various changes for specific properties are proposed as follows:

Amend Schedule “A” – Map B1 of the Zoning By-law to rezone the lands at 0 and 20 Harbour Road as shown in hatching on the map provided from R3-A(6)/R4-A/R6-B/CC-A(4) "h-52" "h-53" (Residential/Convenience Commercial) to R3-A(6)/R4-A/R6-D(9)/CC-A(4) "h-52" "h-53" (Residential/Convenience Commercial) to permit increased building height and residential density.

Amend Schedule “A” – Map B2 of the Zoning By-law to rezone the lands generally located at the northwest corner of Albert Street and First Avenue as shown in hatching on the map provided from R6-B(1) (Residential) to OSP (Park Open Space), given that these lands are proposed to be used as an expansion of Elena Park.
- Amend Schedule “A” – Zoning Map A3 of the Zoning By-law to rezone the lands shown in hatching on the map provided (Rose Valley Community Park) from FD (Future Development) to OSP (Park Open Space).
- Amend Schedule “A” – Maps B4 and North Half of the Zoning By-law to rezone Block 13 in Registered Plan 40M-2605 as shown in hatching on the map provided to remove the “h-14” holding symbol from the CIN/R1-E(21)/R3-A(8) “h-14” (Community Institutional/Residential) zoning of the lands.
- Amend Schedule “A” – Maps B4 and North Half of the Zoning By-law to rezone the lands shown in hatching on the map provided from PCC-A(4)/SSC-B “h-57” (Planned Commercial Centre/Automobile Service Station) to PCC-A(4) “h-57” (Planned Commercial Centre), in part, in order to remove permission for Automotive Service Station uses, and to OSP (Park Open Space), in part, to permit only a park.
- Amend Schedule “A” – Map C3 of the Zoning By-law to rezone 1200 Townline Road North as shown in hatching on the map provided from FD (Future Development) to UT (Utilities), to reflect the use of the lands for a hydro substation.
- Amend Schedule “A” – Zoning Map C4 of the Zoning By-law to rezone the lands shown in hatching on the map provided from MU-B.DBR 60-85/SSC “h-14” “h-30” (Mixed Use/Automobile Service Station) to MU-B.DBR 60-85/SCC-C “h-14” “h-30” (Mixed Use/Automobile Service Station), to specify the category of SSC (Automobile Service Station) zoning that applies.

Zoning: If you wish to be notified of the decision of the City of Oshawa on the proposed zoning by-law amendment, you must make a written request to the Commissioner of Economic and Development Services, 50 Centre Street South, Oshawa, Ontario L1H 3Z7.
- To Appeal:
- Official Plan:
An Official Plan Amendment adopted by Oshawa City Council is forwarded to the Region of Durham for approval, unless it is determined that the Amendment is exempt from Regional approval during the review process. For an exempt Amendment, the decision to adopt by Oshawa City Council becomes final, subject to any appeals during the statutory appeal period.
If a person or public body would otherwise have an ability to appeal the decision of the City of Oshawa to the Ontario Land Tribunal (Tribunal) but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of Oshawa before the proposed Official Plan Amendment is adopted, the person or public body is not entitled to appeal the decision.If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Oshawa before the proposed Official Plan Amendment is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Tribunal, as appropriate, unless in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

Zoning:
